LGA Preparing For Oral Arguments in ProcellaCOR Lawsuit

The LGA and Lake George Waterkeeper, and our co-complainants, the Town of Hague and a lakeside resident, are awaiting word from New York State Supreme Court as to the scheduling of oral arguments in our lawsuit against the Adirondack Park Agency and Lake George Park Commission relative to the use of the herbicide ProcellaCOR in Lake George. Our lawsuit alleges, among other things, that the Park Agency orchestrated a rushed process to approve the use of an herbicide in Lake George despite an outpouring of technical and scientific opposition, procedural errors, and a substantial departure from regulatory requirements protecting freshwater wetlands. The New York State Department of Environmental Conservation was originally named in the suit, but we have since removed them due to the judge’s opinion that the DEC’s involvement was of questionable merit. As the court case progresses, LGA-sponsored scientific efforts continue to apply world-leading freshwater science to studying the potential impacts of the herbicide on the Lake.
